JUDGEMENT

(1.) This intra court appeal filed by appellant-petitioner Yashwant Singh is directed against the order dated 26.05.2011 passed by the Single Bench in S.B. Civil Writ petition No. 03133/2009, whereby the Single Bench dismissed the writ petition on merit as well as in default.

(2.) In the writ petition, the petitioner made the prayer for quashing the orders dated 28.11.2002 and 12.01.2009 (Annex.1 and 2 to the writ petition), whereby the services of the petitioner were terminated after holding an enquiry under Rules 16 of the Rajasthan Civil Services (C.C.A.) Rules, 1958 (for short, 'the Rules of 1958').

The Disciplinary Authority after taking into consideration the evidence available on the record and the enquiry report submitted by the Enquiry Officer passed the impugned order, whereby a penalty of withholding of three grade increments with cumulative effect was inflicted against the appellant-petitioner vide order dated 28.11.2002. Against the said order, the appellant-petitioner preferred a review petition before His Excellency the Governor but vide order dated 12.01.2009, the review petition filed by the petitioner was rejected while considering the fact that due to negligence of the appellant-petitioner, the State has suffered the loss of Rs.24.76 lacs.
