JUDGEMENT

(1.) -

(2.) THIS is a plaintiff's second appeal arising out of a suit for recovery of money by the sale of the mortgaged property.

(3.) HOWEVER for the disposal of the case on hand it is not necessary for me to enter into this controversy lest I might have referred the case to a larger Bench. Even according to the view taken in Indernath Modi's case under certain circumstances presumption of sec. 60 (2) may be raised to hold that the document was duly executed and that the certificate constitutes some evidence.
