(1.)By filing the intra-court appeal, the appellant has challenged the order passed by the learned Single Judge dated 14.02.2017, whereby the writ
petition filed by the petitioner was dismissed.
(2.)In the writ petition order dated 18.12.2009 passed by the State Government was impugned by which the request of the appellant seeking
voluntary retirement was accepted w.e.f. 31.03.2009. Order dated 28.03.2009
was also challenged vide which his request was provisionally accepted.
(3.)Briefly, the facts of the case are that the appellant joined service on 10.12.1976. He applied for voluntary retirement on 06.05.2007. When no
action was taken on his request he sent reminder on 23.03.2009 stating that
due to health reasons he gives 90 days time to process his case for voluntary
retirement. He even applied for leave on medical grounds for 90 days.
Immediately thereafter the request of the petitioner was accepted vide order
dated 28.03.2009 passed by the Director Animal Husbandry Department
w.e.f. 31.03.2009. After the aforesaid request was accepted, the petitioner
applied for withdrawal of his request for voluntary retirement on 30.03.2009.
The order of voluntary retirement was approved by the Government on
