(1.)Through the medium of the instant petition, the petitioners have challenged F.I.R No. 236/2020 for offences under Sections 420/109 IPC of Police Station, Mendhar.
(2.)It is the case of the petitioners that there is a dispute over the ancestral property situated at Sakhi Maidan Tehsil Mendhar District Poonch between respondent No. 2 and petitioners, regarding which a case is pending before the Court of Tehsildar Assistant Collector 1st Class, Mendhar. To buttress his point, learned counsel for the petitioners has placed on record a copy of the petition stated to be pending before the said Court. Petitioners have also placed a copy of the order dated 19.10.2019 passed by the Court of Tehsildar, Assistant Collector 1st Class Mendhar regarding the land in question.
(3.)Having heard learned counsel for the petitioners and having perused the material on record, prima-facie it appears that the dispute between the parties is essentially of civil nature. Therefore, a case for grant of interim indulgence is made out.
