ALI MOHAMMAD MAGREY -
(1.)There is no merit in the instant application, seeking recalling of order dated 17.08.2020, whereby the writ petition bearing WP(C) No. 3924/2019, has been transferred to the Central Administrative Tribunal Bench, Jammu, as the subject matter of the said writ petition is the selection/appointment against the post of Naib Tehsildar, which falls within the ambit of Section 14 of the Central Administrative Tribunals Act, 1985 (CAT Act). The jurisdiction to hear the petition as a Court of first instance, therefore, lies with the Central Administrative Tribunal (CAT) constituted under the provisions of the CAT Act. Accordingly, the Court has rightly passed the order dated 17.08.2020, by transferring the said writ petition to the Central Administrative Tribunal, Jammu Bench for further proceedings.
(2.)In view of above, there is no scope in the instant application for interference, as such, is dismissed.
