JUDGEMENT

Ali Mohammad Magrey - (1.)Bail App. No. 18/2020 1. By the present application, the applicants who are six in number, are seeking bail in anctipation of their arrest in case FIR No. 147/2019 of Police Station Shopian, registered under Sections 147, 148, 323, 447 and 307 of CrPC.
(2.)When asked, Mr Tariq M. Shah, learned counsel for the applicants submits that despite having approached the court of first instance i.e. Principal Sessions Judge, Shopian, for the same relief, the outcome is the order passed on 11.03.2020, which order as stated is recorded without any reasons.
(3.)Perusal of the order reveals that the learned Principal Sessions Judge, Shopian, has without application of mind and by adhering to non-reasoning, rejected the bail application with liberty to the applicants to seek regular bail Bail App No. 18/2020 c/w TRP (Crl) No. 13/2020 before the court of learned Magistrate. In the order it is mentioned that due to certain reasons, anticipatory bail application stands returned.
