These appeals arise out of common judgment and order, dated 22.09.2015, passed by the learned single Judge of this Court on a writ application filed under Article 226 of the Constitution of India by Mora Tollways Limited, a company incorporated under the provisions of the Companies Act, 1956 (hereinafter referred to as the "Companies"). The said Company is the appellant of L.P.A. No. 2158 of 2015. The Bihar State Road Development Corporation Limited and others (hereinafter referred to as the "Corporation") and its functionaries, who were impleaded as respondent Nos. 3 to 9 in the writ proceedings before learned Single Judge, have also questioned the legality of the same judgment and order passed by the learned single Judge by filing LPA No. 2084 of 2015.
(2.) This is the reason why all the three appeals have been heard together, with the consent of the parties, and are being disposed of by the present common judgment and order.

Before I advert to the extensive arguments advanced on behalf of the Company, the Corporation and the State of Bihar, it would be apt to take note of the conclusion arrived at by learned single Judge in the order under appeal, and legal reasoning assigned for such conclusion since sustainability of the said order is in question, in the present batch of appeals. For the said purpose, I have considered it appropriate to take brief note of the admitted facts mentioned by learned single Judge, which are foundation for arriving at the said conclusion.
