(1.) IT seems that the learned counsel for the petitioner lost interest for want of instruction from the petitioner, who is the widow, and thus has not appeared since quite a long time. However, this Court considering the agony of the widow directed the learned counsel appearing for the Jharkhand State as well as the learned Standing Counsel appearing for the State of Bihar to ensure final calculation anpayment of the dues by producing Banr, drafts in favour of the petitioner.

EARLIER on 26.8.2005, learned Standing Counsel No. X appearing for the State of Bihar had produced four sanction orders with respect to leave encashment, provisional gratuity, due salary and provisional family pension, which were kept on record. He submitted that the draft for the said amount alongwith the amount of cost was being prepared. Accordingly, the matter was adjourned for listing today. Today, he has produced four Bank drafts of Rs. 24,592/, Rs. 25,764/ -, Rs. 10,581 /, Rs. 1,17,640for payment of the dues and Rs. 1,000/ -towards cost awarded by this Court.
(3.) HAVING regard to the facts and circumstances, the apology tendered by the authority concerned is accepted and the M.J.C. application is, accordingly, disposed of.
