JUDGEMENT
VIVEK SINGH THAKUR,J. -
(1.)Present petition, under Section 482 Cr.P.C., has been preferred, on the basis of compromise arrived at between the parties, for quashing of criminal complaint No. Whether Reporters of Local Papers may be allowed to see the judgment? Yes 77 of 2017 filed under Section 156(3) of Cr.P.C. by respondent No.2 Anuradha for registration of case against the petitioners/accused under Sections 406, 498-A, 323 and 506 read with Section 34 IPC and consequential proceedings initiated in pursuance thereto against the petitioners.
(2.)Today, petitioners as well as respondent No.2 are present in person. They have been Identified by their respective counsel. Statements of petitioner No.1/accused and respondent No.2/complainant, have been recorded on oath separately.
(3.)Respondent No.2, who is complainant in present case, has stated that she was married to petitioner No.1 Kirti Syal on 6.9.2013, but, unfortunately, due to differences of opinion and some other reasons, their relations have ended and they have divorced with mutual consent. She has further stated that criminal complaint, in present case, filed by her during subsistence of marital ties, is pending in the trial Court, but now, as her relations with Kirti Syal and his family have ended and everything has been settled, she wants to live in peace and not to remember anything of the past and therefore, she has decided to compromise the matter and accordingly, she has also signed the compromise deed, which has been placed on record as Annexure P-4. She has also endorsed her signatures on the compromise deed. She has further stated that in view of above, she does not want to continue the criminal proceedings against petitioner Kirti Syal and his family members and, therefore, has prayed for quashing of complaint as well as criminal proceedings instituted in consequences thereto against the petitioners. She has stated that she has signed the compromise deed and made the statement in Court out of her free will, consent and also without any fear, threat, pressure or coercion.
