JUDGEMENT

(1.) PETITIONER 's husband was engaged as Beldar on daily wage basis with effect from 1978. He had completed ten years of uninterrupted service as on 31.12.1993. He was directed to produce the birth and other certificates vide letter dated 7th January, 1995. However, unfortunately, petitioner's husband died on 25th January, 1995 before submitting the documents/certificates to the concerned authority. So far as the case of the petitioner seeking family pension is concerned, the same is not covered under the Rules since her husband has not worked even for a day on regular basis.

(2.) NOW the Court will advert to whether the respondents have overlooked the case of the petitioner for grant of compassionate appointment or not. Respondent/State was directed to seek instructions whether the petitioner can be offered appointment on compassionate grounds or not. Mr. P.M. Negi, learned Deputy Advocate General has placed on record the copy of letter dated 15th July, 2010 issued by the Principal Secretary (Finance to the Government of Himachal Pradesh. The text of the letter reads thus : - "On the above subject, I am directed to say that as per present policy of the Government, this department is considering those cases where the applicant is a widow or cases of those applicants whose both parents are not alive. It is, therefore, requested that for the present only those cases may be sent to this department where applicant is a widow and cases of applicants whose both parents are not alive. -

(3.) IN a view of the observations made hereinabove, the petition stands disposed of, so also the pending application (s), if any. There shall be no order as to costs. M.R.B.
