JUDGEMENT

(1.) This order will dispose of F.A.O. Nos. 399 and 400 of 1989 since common questions of law arise for determination in these appeals.

(2.) Shri S.S. Sandhu, PSE-I, Superintending Engineer, SYL Construction Circle No. 3, Chandigarh (Respondent No. 5) is the Arbitrator who rendered the Award. He was not served in the appeals. His name was deleted from the array of parties since he was not a necessary party in the appeals.
