A Division Bench of this Court on 31.8.2006, directed the Director, Northern Indian Institute of Fashion Technology to consider the case of the petitioner for condonation of lectures and permit the petitioner to appear in the supplementary examination for 3rd Semester after condoning the lectures. The Court observed that the Director shall take a sympathetic view.
(2.) IN terms of the directions issued by this Court, the lectures of the petitioner were not condoned and a detailed speaking order was passed on 20.11.2006. IN separate replies filed on behalf of the respondents, it has been stated that the petitioner has taken a wrong stand that his mother was ill. As a matter of fact, the petitioner never submitted any medical certificate nor any such representation/application was ever received regarding health of his mother. Still further, it has been pointed out that the significance of prospectus and the promotion policy will become insignificant if the petitioner was to get the relief of condonation of lectures without there being any such provisions in the Prospectus Rules. Since a detailed speaking order has been passed by the Director of the INstitute, I do not find that the respondents have violated the orders passed by this Court. It is for the petitioner to seek his remedy against the order passed by the Director on 20.11.2006 in appropriate proceedings. However, I do not find that any case for initiating contempt proceedings against the respondents, is made out. Consequently, the present petition is dismissed.
