JUDGEMENT

(1.) Offence alleged is under section 420 IPC. Case against the petitioner is that he entered into an agreement to sell a house and received a sum of Rs. Nine lacs as earnest money, but he refused to execute the sale deed.

(2.) Counsel for the State says that there are other FIRs registered against the petitioner being FIR No.625 dated 17.6.2001, under section 307 IPC and Arms Act and FIR No.23 dated 8.1.2006, under sections 420/467 IPC for dishonour of cheque. It is further pointed out that a sum of Rs. Nine lacs was taken by the petitioner by misrepresenting that he was the owner, but later on he did not execute the sale deed on the ground that he was not the owner.
