JUDGEMENT

(1.) COUNSEL for the petitioner states that on 27.9.2005, the petitioner could not appear before the trial Court, as he was indisposed. Despite his request, his counsel did not file an application for exemption from personal appearance. The trial Court, therefore, cancelled his bail bonds, forfeited the surety and issued warrants of arrest for 5.11.2005. On 5.11.2005, the petitioner, as advised by his counsel, instead of surrendering before the trial Court, filed an application for exemption from personal appearance. The said application was dismissed and warrants of arrest issued, once again. It is contended that the petitioner's non-appearance was neither intentional nor malafide but on account of his illness. Notice of motion to Advocate General, Punjab, for 4.9.2006. In case, the petitioner appears before the trial Court within a fortnight from today, he shall be released on interim anticipatory bail to the satisfaction of the trial Court.
