(1.) RESPONDENT No.1-plaintiff filed a suit for declaration, claiming ownership of the property, in dispute. She also laid challenge to the sale deeds executed, with regard to the said property, in favour of the defendants. It was her case that originally, her father Hari Singh was owner of the property, in dispute. He died in the year 1973. However, by playing a fraud, sale deeds, under challenge, were got executed on the basis of general power of attorney, which was admittedly, got executed in the year 1986. Both the Courts below have found it as a matter of fact that power of attorney was a forged document and consequently, the sale deeds were set aside. So far as the appellant is concerned, he has purchased the property, in dispute, on 20.4.1992, during pendency of suit and also in violation to the status quo order passed by the trial Court. Under these circumstances, he was rightly held not entitled to get any benefit, on the ground that he was a RSA No.4818 of 2004 -2- bona fide purchaser. Opinion arrived at is perfectly justified and is based upon proper appreciation of evidence on record. No case is made out for interference, as counsel has failed to raise any substantial question of law at the time of arguments. Dismissed. March 03, 2006 ( Jasbir Singh ) gk Judge
