(1.) HEARD. Offence alleged is under sections 307/326/323/324/506/34 IPC and section 3(ii) of the SC and ST (POA) Act, 1989. It is stated by counsel for the State that the petitioners are attributed head injuries and one of the head injuries has been found to be dangerous to life. The said injury is attributed to Gurjinder Singh and Charanjit Singh jointly.

COUNSEL for the petitioners points out that common intention is a question of trial and injury attributed to Gurcharan Singh petitioner No.1 is not dangerous to life and he has been in custody for the last about seven months. Without expressing any opinion on merits, Gurcharan Singh petitioner is granted bail to the satisfaction of CJM/ Duty Magistrate, Sirsa and while declining bail to other two petitioners, namely, Gurjinder Singh and Charanjit Singh, a direction is issued that if prosecution evidence is not concluded within four months from today, for reasons not attributable to the petitioners, petitioners Gurjinder Singh and Charanjit Singh will also be granted bail by the trial court on appropriate conditions. The petition is disposed of.
