(1.) ACCORDING to the direction issued in C.W.P. No. 14860 of 1992, decided on 4.3.2003, back wages to the extent of 50% admittedly has been paid and order dated 18.10.2005 showing the aforementioned factual position was placed on record with C.O.C.P. No. 1361 of 2003, when the same came up for consideration on 20.10.2005. However, while disposing of the contempt petition, on the insistence of the counsel for the petitioner it was observed that if there was any other dispute concerning the payment which might be outstanding then the petitioner was to make representation to the respondent. Obviously, that observation was made with regard to the 50% of the back wages, which admittedly have been paid. Therefore, no fresh contempt petition would be maintainable with regard to payment of pensionary benefits as there is no mandamus in that regard issued by this Court. Dismissed.
