(1.) APPLICANT Dr.(Mrs.) K.K. Sandhu challenged the promotion to the post of Professor of Obstetric and Gynaecology through Civil Writ Petition No. 5667 of 1981 of Dr. (Mrs.) Sukhdev Kaur Grewal to whom she was senior as Assistant Professor.
(2.) IN its written statement the Government took the position that the Government had not finally held Dr. Sandhu ineligible for the given post to which during the pendency she had already promoted vide order dated 28.4.1982.
(3.) THE Government took the final decision in the matter on 7.10.1983. The petitioner has moved the present contempt petition against the concerned officials as it has been alleged that there had been deliberate non-compliance with the direction of this Court in regard to the time by which the decision is regard to the eligibility of the petitioner for promotion to the post of Professor of Obstetrics and Gynaecology had to be taken. That the final decision in the matter has been taken well beyond the indicated period is there for all to see. The only question that arises is as to whether the delay in taking the decision beyond the period allowed to the State Government has been deliberate or bonafide.
