KRISHAN Lal, complainant, father of deceased Anu @ Anamika, has filed this appeal under Section 372 Cr.P.C. being the victim, against the acquittal of respondents Aad Ram and Manju for an offence under Sections 498 -A and 304 -B IPC read with Section 34 IPC and in the alternative under Section 302 read with Section 34 IPC by learned Additional Sessions Judge, Sirsa.
(2.) WE have heard learned counsel for the appellant and have also perused the file carefully.
(3.) KRISHAN Lal, complainant, had made statement Ex.PA to the police wherein he had stated that his daughter Anu @ Anamika was married with Atma Ram on 10.3.2012. Sufficient dowry was given at the time of marriage. But soon after the marriage, accused started troubling Anu @ Anamika (since deceased) for bringing more dowry. Complainant had approached Ranbir Singh, elder brother of the family, who was running confectionary shop at Dabwali and requested him to prevail upon the accused not to harass his daughter. Few days thereafter, Dharampal and his wife Chandermukhi alongwith Ranbir Singh came to Dhani 2 -C, Shri Ganganagar and they got Atma Ram and their daughter settled in a house at Guru Jambeshwar Nagar, Dabwali. Dharampal and his wife used to live in that house. Atma Ram started working in the garment shop opposite the Railway Station. Respondents Manju (mother -inlaw) and Aad Ram (father -in -law) used to visit Anu @ Anamika alongwith Ranbir Singh and they used to trouble deceased Anu @ Anamika for bringing more dowry. Deceased used to narrate the incident to the complainant and his wife and also to his son Lakshay. She used to tell that accused are demanding Bolero vehicle. Complainant again requested the accused but to no avail. Complainant further alleged that on Sunday, his daughter Anu @ Anamika visited them and returned to Mandi Dabwali. On her return, his son -in -law gave him 2 -3 calls and told them that they would kill Anu @ Anamika if he did not give the Bolero vehicle. On 21.9.2012 at 3.40 p.m. he received a call from mobile phone of accusedrespondent Aad Ram that his daughter was not well and asked him to reach Dabwali. Then he alongwith his brother Mastan Singh and son Lakshay and other relations, went to the house of accused Atma Ram and found the dead body of Anu @ Anamika lying in a room on the first floor of the house. On enquiry, they came to know that Anu @ Anamika has been murdered by hanging by accused Aad Ram, Dharampal, his wife and Ranbir Singh.
