(1.) THE petitioners have filed this petition under Section 482 Cr.P.C. praying for quashing of FIR No. 38 dated 6.2.2011 (Annexure -P.1) registered for the offences under Sections 323, 506, 148 and 149 IPC and Prevention of Damage of Public Property Act No. 3, 1984 at Police Station 'A' Division, Amritsar City and all subsequent proceedings arising therefrom in view of the compromise dated 2.11.2013 (Annexure -P.2).

THE FIR has been registered on the statement of complainant -Anju Chopra alleging that the petitioners along with 2/3 other unidentified persons armed with 'Kirpans' raising 'Lalkara', hurling abuses and breaking the street lights came near to her house. The complainant went to them and asked what happened, then Labha Singh gave a blow with his Kirpan' on the wrist of her right arm. Her son Rocky came out and the people of the street also came out, then the accused while raising Lalkara' ran away from the spot and while going away the accused also damaged the Kariana' shop of Harbans Lal with Kirpan' and also threw away the counter. Now with the efforts of the respectable persons of the locality, the matter has been compromised between the parties and they have decided to settle their dispute amicably and to withdraw all the litigation pending between them.
(3.) LEARNED Assistant Advocate General, Punjab, on instructions from the Investigating Officer admits the factum of compromise and submits that in case the parties have indeed settled their dispute, the State would have no objection to the quashing of the FIR in view of the law laid down by the Hon'ble Supreme Court.
