JUDGEMENT

(1.) Shortage in attendance of lectures not having been condoned and the petitioner Sanjeev Kumar Jain thereby being rendered ineligible to appear for the second year examination of the Three Year Diploma Course in Civil Engineering, is that brings this matter before us in proceedings under Article 226 of the Constitution.

(2.) The relevant rule requires that every student shall have to put in a minimum of 75% of lectures and tutorial and not less than 75 per cent of all laboratories, practical and project work (separately) in all the subjects in each semester separately and further has secured at least 60 per cent attendance in each subject i.e. theory and practicals separately in each semester

(3.) As regards the condonation of shortage in attendance, the rule further says, "shortage of attendance can be condoned upto 5 per cent on medical grounds by the Principal and further upto 5 per cent by the Director Technical Education, Punjab, in genuine cases.
