(1.) THE writ petition challenges the order passed by the Financial Commissioner (Appeals) under the Punjab Land Revenue Act of 1987. While disposing of the appeal, the Financial Commissioner had held that in the manner of disposal of the appeal by the Assistant Commissioner Ist Grade (Tehsildar), Batala, he shall frame fresh mode of partition by deleting the allotment of khasra No. 5 -R/11 to Ram Singh, who is the Petitioner before this Court, and that final partition was to be made on the basis of revised mode of partition by keeping the possession of the parties intact with minimum disturbance. The Financial Commissioner had clarified that the order passed by the Collector could not be understood as denying to Ram Singh, the present Petitioner, a right of allotment, if he was found to be in possession of the aforesaid khasra number. The Financial Commissioner had held that in the manner of taking a revised mode of partition, the properties held in respective possession of parties would be duly considered so that there was minimum disturbance to their respective possession. There is no ground to take a different view from how the matter has been disposed of by the authority. I find nothing improper or wrong to quash the same. The writ petition is dismissed and consequently, it will mean restoration of the direction already contained in the order of the Assistant Collector Ist Grade (Tehsildar), Batala, in terms of the directions given by his decision dated 30.01.1987 under the title Gian Singh v. Ram Singh and Ors.. Appropriate decision shall be taken by the Assistant Collector, Ist Grade (Tehsildar), Batala, as expeditiously as possible.
(2.) THE writ petition is disposed of with the above directions.
