JUDGEMENT

(1.) THIS writ petition has been filed as a Public Interest Litigation seeking an order prohibiting one Vijay Kumar (not impleaded) from performing the duties of a Dispenser in Homeopathic Dispensary at Baba Bakala, District Amritsar. According to the petitioner, the aforesaid Vijay Kumar is a Class -IV employee and he is not qualified to work as a Dispenser. The actions of the respondents in permitting the aforesaid person to so act are therefore contended to be opposed to public interest carrying the potential of causing harm to the people/patients visiting the Homeopathic Dispensary in question.

(2.) A reading of the order dated 01.09.2010 (Annexure P -3) by which the aforesaid Vijay Kumar has been permitted to work as a Homeopathic Dispenser prima facie discloses that the aforesaid person may possess the necessary qualification required for the post of Dispenser though his engagement is as a Class -IV employee.
