JUDGEMENT

(1.) After hearing counsel for the parties, a direction is issued to the Rent Controller to dispose of the matter pending before him as expeditiously as possible.

(2.) It is stated that the petition is at the stage of the recording of the evidence of the tenant. It is in this behalf said that some of the witnesses that the tenant wishes to examine are such as cannot be produced by him on his own, but have to be summoned. Counsel for the tenant, however, undertakes to ensure service of summons upon all the witnesses that he may summon by taking summons dasti for the date that may be fixed for their evidence and further that if such service is not effected, no further adjournment for the evidence of such unserved witness or witnesses shall be sought.

(3.) The Rent Controller is accordingly hereby directed to fix an early date for the recording of the remaining evidence of the tenant. Dasti summons may be given to the tenant for effecting service upon his witnesses. If, for any reason, some of the tenant's witnesses cannot be summoned for the date fixed, another adjournment be granted to the tenant for this purpose. If the tenant fails to effect service upon all or any of his witnesses for either of these dates, no further opportunity be afforded to the tenant, for this purpose. In other words, the recording of the evidence of the tenant be completed on the next date of hearing or at any rate during the next two dates of hearing.
