JUDGEMENT

Hitesh Kumar Sarma, J. - (1.) This is a criminal appeal, filed under Section 374(2) of the Cr.PC, against the judgment and order, dated 29.9.2009, passed by the learned Sessions Judge, Darrang, Mangaldai, in Sessions Case No. 82(DM)/2004, convicting the accused-appellant under Sections 366/451 of the IPC and sentencing him to undergo rigorous imprisonment for 5 years and to pay a fine of Rs. 5,000/- with a default clause under Section 366 of the IPC and also to undergo rigorous imprisonment for 6 months and to pay a fine of Rs. 1,000/- with a default clause for offence under Section 451 of the IPC.
(2.) I have heard Mr. A. Khaleque, learned counsel for the accused-appellant as well as Mr. B.J. Dutta, learned Additional Public Prosecutor for the state respondent.
(3.) I have scanned the judgment of the learned trial court and also perused the record of the learned trial court including the evidence adduced by both the parties.;
