(1.) Heard Mr. M.H. Laskar, learned counsel for the petitioner as well as Ms. G. Sarmah, learned counsel for respondent no. 1; Mr. A. Kalita, learned counsel for respondent nos. 2, 3 and 4; Mr. A.I. Ali, learned counsel for respondent no. 5 and Ms. U. Das, learned counsel for respondent no.6.
(2.) Petitioner assails ex parte order dated 19.05.2017 passed by the Foreigners' Tribunal, Hojai, Sankardev Nagar in Case No. F.T/H/4100/2012, declaring the petitioner to be a foreigner, who illegally entered into India after 25.03.1971.
(3.) Mr. Laskar submits that the order of the Tribunal was passed without granting opportunity to the petitioner to contest the case and/or opportunity to discharge the burden as required of him under Section 9 of the Foreigners' Act, 1946. It is stated that no notice, whatsoever, was served upon the petitioner.;
