JUDGEMENT

Michael Zothankhuma, J. - (1.) Heard Ms. H. Lalmalsawmi, learned Amicus Curiae and Mrs. Linda L. Fambawl, learned Addl. Public Prosecutor for the State of Mizoram.
(2.) The present appeal has been filed against the JudgmentOrder dated 27.06.2017, passed by the learned Special Court, POCSO Act, Aizawl, in S.C No. 128/2014 (Crl. Tr. No. 1551/2014), arising out of Bawngkawn P.S Case No. 163/2014, by which the appellant had been convicted under Section 6 of the POCSO Act, 2012 and sentenced to undergo 12 years Rigorous Imprisonment with a fine of Rs. 1,000/-, in default 20 days Simple Imprisonment.
(3.) The prosecution story of the case in brief is that on 24.08.2014, a written FIR was submitted by Ibemtombi of Bawngkawn stating that on 24.08.2014, between 8:00 A.M to 9:00 A.M, her daughter M. Romila, 11 years was sexually assaulted by the victim's stepfather in their house at Bawngkawn, Lunglei Road, during her absence for which her daughter sustained injuries and was admitted at Civil Hospital, Aizawl, Gynae Ward. Hence, Bawngkawn P.S Case No. 163/2014 dated 24.08.2014 under Section 376(2)(f)(i) IPC, read with Section 8 of the POCSO Act was registered and duly investigated into. Charges were farmed against the appellant on 102015 under Section 6 of the POCSO Act. Thereafter, the Trial started wherein, 11 prosecution witnesses were examined.;
