(1.) Heard Mr. K.N. Choudhury, learned Senior Counsel for the petitioner, assisted by Ms. R. S. Choudhury, Advocate as well as Mr. K.K. Mahanta, learned Senior Counsel representing all the respondents, assisted by Mr. B. Deka, Advocate.
(2.) Question posed is whether the respondents could retire the petitioner from service with effect from 31.12.2012 on attaining the age of 60 years despite the claim that she was entitled to be in service up to 31.12.2014 to the age of 62 years.
(3.) Petitioner joined as Faculty Research Associate at the North Eastern Institute of Bank Management (NEIBM) [now called the Indian Institute of Bank Management (IIBM)']) on 23.09.1985. The IIBM is located at Guwahati and is a Society registered under the Societies Registration Act, 1860. On the date of retirement the petitioner served as an Associate Professor. On 23.11.2012 she was served with the letter informing that she will be retiring at the close of business of 31.12.2012 in terms of Rule 29 of the Staff Service Rules of the IIBM.
