JUDGEMENT

Manojit Bhuyan, J. - (1.) Heard Mr. B.D. Konwar, learned senior counsel representing the petitioner as well as Mr. A. Deka, learned counsel representing the respondent No.1. Also heard Ms. M. Sarma, learned counsel representing the respondent Nos.2, 3 & 5. Mr. K. Nayak, learned counsel represents respondent No.4.
(2.) Having regard to the facts in issue, service of Notice on respondent No.6 is not deemed necessary and the writ petition is taken up for final disposal at the Motion stage on consensus arrived at between the parties.
(3.) The petitioner is serving as a Block Accountant on contractual basis under Axom Sarba Siksha Abhiyan Mission and presently posted at Chhaygaon Block, Kamrup District. Expressing personal difficulties as she has to tend to her 5 year old son and mother-in-law at her present place of residence in Dispur, Guwahati, she had made request to the authorities to post her somewhere closer to her residence in Guwahati as she has to travel almost 50 k.ms. daily to and fro her place of work at Chhaygaon. Instead of considering her prayer/request, an order dated 28.6.2018 came to be issued under the hand of the respondent No.2 transferring her from Chhaygaon Block to Boko Block which is further away from her place of residence in Guwahati. Request for re-visiting the decision taken was made by several representations, the last being submitted on 4.7.2018 to the Commissioner & Secretary to the Government of Assam, Elementary Education Department.;
