JUDGEMENT

M.R.PATHAK, J. - (1.) Heard Mr. T. U. Laskar, learned counsel for the appellant and Mr. S. P. Choudhury, learned counsel for the respondent.
(2.) This Matrimonial Appeal under Section 28 of the Hindu Marriage Act is against the Judgment and Order dated 29.04.2014 passed by learned Principal Judge Family Court, Cachar, Silchar in F.C. (Civil) No.102/2006, whereby appellant's petition under Section 13(1)(ia) of the Hindu Marriage Act for dissolution of his marriage with the respondent was dismissed.
(3.) The appellant is an employee in the electrical department in the Paper Mill of Hindustan Paper Corporation at Pachgram. As per his work, he needs to leave his house early morning so as to join his duties and returns home late at night. Occasionally, he is also required to stay back in the Mill itself during his shift duties at night. After the death of his wife, Namita Das in June 1999, as it was very difficult on his part to look after his three minor children, two daughters and a son, he kept his niece Smti. Rina Das, aged about 17-18 years, daughter of his first cousin Sri Rishi Das, who resides adjacent to his house as care taker of his three children.;
