JUDGEMENT

ACHINTYA MALLA BUJOR BARUA,J. - (1.) Heard Ms. NS Thakuria, learned counsel for the petitioner. Also heard Mr. S Bharali, learned State counsel.
(2.) The office note dated 23.03.2010 indicates that A/D in respect of respondent No.5 was served in the year 2010 itself, but the said respondent had chosen not to appear. Therefore, it is deemed appropriate that the matter be proceeded in the absence of respondent No.5.
(3.) The petitioner who is a nephew of an earlier Gaonburah had participated in a selection process for the vacant post of Gaonburah of Banmukh Chutia and Banmukh Dihingia Gaon under Mouza Konwarpur in the Sivasagar district. The said selection process was initiated as per the Notification dated 17.08.2009 of the Deputy Commissioner, Sivasagar. In the said Notification of advertisement, it has been provided that candidates who are the resident of the concerned village and are recommended by the Mouzadar and by the local people would be given priority over others in the matter of appointment. In the instant case, the petitioner being the nephew of the earlier Gaonburah and upon being duly recommended by the local people of the village had participated in the selection process.;
