(1.) Heard Mr. KN Chowdhury, learned senior counsel assisted by Mr. J Patowary, learned counsel for the appellant. Also heard Mr. S
Saikia, learned Additional Advocate General, Arunachal Pradesh assisted by Mr. NNB Choudhury,
learned Senior Government Advocate, Arunachal Pradesh and Mr. A Chandran, learned Junior
Government Advocate, Arunachal as well as Mr. PD Nair, learned counsel for respondent No.6.
(2.) This appeal is directed against the order dated 4.10.2018 passed by the learned Single Judge in WP(C) 338(AP)2018 and IA(C) 152(AP)2018, whereby, while vacating the interim order passed
earlier, the writ petition filed by the present appellant was disposed of, negating, in essence,
challenge to the order dated 3.7.2018 passed by the Principal Chief Conservator of Forest (PCCF) &
Principal Secretary, Environment and Forest (E&F) and permitting the present respondent No.6 to
remain at Tale Wild Life Sanctuary Range till March, 2019.
(3.) By a transfer order dated 24.10.2017, the appellant, who was posted as Range Forest Officer at Hapoli Range under Hapoli Forest Division was transferred to Tale Wild Life Range under Hapoli
Forest Division, where respondent No.6 was posted. One Tage Hania, Range Forest Officer of
Tawang Range was posted in the place of posting of the appellant. Respondent No.6 was transferred
to the office of Director, Arunachal Pradesh Forest Training Institute at Roing. The
'Remarks' column of the order of transfer would disclose that though transfers were ordered,
respondent No.6 would continue to be retained at Tale Wild Life Range under Hapoli Forest
Division till March, 2018 and the present appellant can take charge only after March, 2018. In view
of the above arrangement, Tage Hania was also to take over charge from the appellant after March,
