JUDGEMENT

Ajit Singh, J. - (1.) By this appeal under Section 19(1) of the Family Court's Act, 1984, appellant husband Dilip Das has challenged the impugned order dated 26/05/2017 passed by the Principal Judge, Family Court - II, Kamrup (Metro), allowing the respondent wife Dipanjali Das's petition for dissolution of their marriage.
(2.) According to the respondent, she was married to the appellant on 02.02.2009 and for the first year of their marriage, their marriage was peaceful. But, the appellant changed his behaviour and attitude towards her slowly and started to treat her with cruelty. He often used to call her by names of animals and also demanded dowry which she failed to comply. The appellant used to treat her like a maid servant and often used to scold her on petty matters. In the month of June, 2011 the appellant even tried to drive her out of the house and on 20.04.2011 he tried to commit murder by mixing poison in her meals, but to her utter good fortune she did not consume her meal that day and thus got saved. On 18.07.2011 when she returned from temple with her father-in-law, the appellant assaulted her and locked her inside a room. When she cried, the neighbours came for her rescue and her parents also came along with her elder brother. But the appellant confined her elder brother too inside a room and also tried to kill him. However, they were saved at the intervention of the neighbours and the parents of the respondent took her along with them. Since then she has been residing there with her parents. She lodged a First Information Report in Azara Police Station on 18.07.2011 regarding the said incident and the appellant was arrested on the next day. The respondent has stated that she has lost all love and affection for the appellant and as such prayed for a decree of divorce.

The appellant contested the suit by filing written statement denying the allegations levelled against him and on the contrary alleged that the respondent being a highly ambitious lady used to demand costly articles for herself and as he could not satisfy her demands, she used to misbehave with him as well as his other family members. She is a quarrelsome lady and stated that all her allegations were frivolous and thus prayed for dismissal of the suit.;
