JUDGEMENT

- (1.) BOTH these appeals No. 265/2005 by complainant and No. 634/2005 by opposite parties arise from the order dated 31.1.2005 passed by District Consumer Disputes Redressal Forum, Bhopal in Case No. 415/2004.
(2.) BY the order impugned the Forum below has directed that on complainant making balance payment of Rs. 39,280, over and above, the payments already made by him to the opposite parties, the latters shall complete the construction of the house and deliver the same to the complainant.
(3.) THE opposite parties who are builders and have also formed a co -operative society, had not only executed sale deed of a plot in favour of the complainant, but also undertook to construct house for him on the said plot. It appears that the house is also nearing completion. However, the dispute is regarding the total amount payable by the complainant to the opposite parties towards cost of the said house. According to the complainant he was required to pay only Rs. 3,35,000 towards cost of construction, over and above, the amount of Rs. 1,35,000 already paid for the cost of the plot. It was further alleged that the complainant has paid a total sum of Rs. 6,10,720 to the opposite parties and still the latters have not completed the construction and delivered possession thereof to the former.;
