M.V.MURALIDARAN, J. - (1.) This appeal is directed against the decree and judgment dated 30.12.2010 passed in Original (Money) Suit No.13 of 2008 on the file of the Ld. Civil Judge, Senior Division No.II, Manipur East, whereby the learned Judge decreed the suit by directing the appellants herein to pay a sum of Rs.1,00,000/- with interest at the rate of 6% per annum from the date of decree till the date of realization.
(2.) The respondent is the plaintiff and the appellants are defendants in the suit.
(3.) Brief facts are that the respondent had love affair with the first appellant for two years. On 09.11.2008, she eloped with the first appellant and stayed the whole night with him to become his wife. On 10.11.2018, the father of the first appellant i.e., the second appellant, along with some persons came to the house of the respondent for "haidokpa ceremony". On the request of the second appellant, the father of the respondent agreed to perform the marriage ceremony and also agreed to settle the date of marriage on another date. On 12.11.2008, the second appellant along with his relatives came to the house of the respondent for fixing the date of marriage could not be fixed as the first appellant had already eloped with one Lakshmi Devi of Lilong and at first, a settlement with the family of the said girl is required. Thereafter, the marriage was not performed between the respondent and the first appellant. Stating that a great damage was caused to the reputation/dignity of the respondent by the first appellant by posing himself as a bachelor and that the second appellant did not disclose the truth on "haidokpa ceremony" and also stating that the whole life of the respondent was closed, the respondent has filed the suit for damages to the tune of Rs.2,00,000/- payable by the appellants.;
