JUDGEMENT

AMRITA SINHA,J. - (1.) The petitioner no.1 is the widow and the petitioner no.2 is the son of one Lala Bauri, who was an employee of the Eastern Coalfields Limited. The employee died in harness on 1st April, 1999. The widow made an application for being appointment on compassionate ground. The application was kept pending.
(2.) The widow approached this Court by filing a writ petition being WP No. 42 of 2011 which was considered and disposed of by an order dated 19th April, 2011, whereby the Court directed the Chief General Manager-cum-General Manager, Eastern Coalfields Limited, Kenda Area to take a decision with regard to the application of the petitioner dated 1st May, 2000 for her appointment on compassionate ground by passing a reasoned order in accordance with law taking into consideration the order dated 13th February, 2003 passed by the Assistant Labour Commissioner (Central), Asansol after giving an opportunity of hearing to the petitioner within a specified time period.
(3.) In compliance of the order passed by this Court the General Manager, Eastern Coalfields Limited, Kenda Area passed a reasoned order on 14th September, 2011 and opined that the application of the petitioner for employment may be considered on compassionate ground under clause 9.3.2 of the NCWA. The concerned officials were advised to process the case of the petitioner no.1.;
