(1.) It appears that pursuant to the order passed by the Court on 17th October, 2019, the petitioner tried to effect service upon
the respondent. Copy of the petition was booked for delivery on 18th
October, 2019 and the track report annexed with the affidavit of service shows that the item was out for delivery but could not be served as the addressee was absent.
(2.) The petitioner relies upon Section 3 of the Arbitration and Conciliation Act, 1996 and submits that the item was sought to have been served upon the respondent in his address which is the last known place of his business.
(3.) The petitioner relies upon a newspaper reporting dated 26th September, 2019 annexed with the supplementary affidavit to indicate that the respondent was trying to transfer his shares which he held in GATI.;
