(2.) This application has been filed under Section 245Q(1) of the IT Act, 1961 (for short 'the Act'). Clearance from the Committee on Dispute (COD) has not been obtained till date. We granted time to the applicant to approach the concerned Authority for obtaining clearance from the COD on 28th April, 2004. It represented that the matter is still pending consideration of COD and it is requested the case may be adjourned for three months.
(3.) HAVING regard to the circumstances of the case particularly the fact this application was filed as long as back in 2001, we suggested to Mr. Srinivasan that we would give option to the applicant to withdraw with liberty to approach the Authority in event COD grants clearance.;
