JUDGEMENT

(1.)Heard Mr. D. K. Biswas, learned counsel appearing for the petitioner as well as Ms. P. Dhar, learned standing counsel
appearing for the respondents No.1 & 3 and Mr. R. Datta,
learned counsel appearing for the respondent No.2.
(2.)The writ petitioner who is presently serving as the Chief Librarian of the High Court of Tripura was so appointed
with effect from 01.07.2014. The petitioner was initially
appointed as the Assistant Librarian in the year 1989 and in
the course of time he was appointed in the post of the
Librarian cum Research Officer which is the Feeder post for
the promotion to the post of Chief Librarian. It may not be out
of place to mention that the relevant rules for recruitment to
the post of Chief Librarian provide that the post of the Chief
Librarian is to be filled up by promotion from the post of
Librarian-cum-Research Officer on the basis of merit-cum-
seniority, failing which by direct recruitment after taking
competitive examination and fulfilling the eligibility criteria
viz. (i) Law degree (ii) Degree in Library Science having
proficiency in computer and (iii) in case of promotion, three
years experience as Librarian-cum-Research Officer. As the
petitioner was found suitable for the post he was appointed as
the Chief Librarian on promotion with effect from 01.07.2014.
(3.)The grievance canvassed in this writ petition in short is that if the petitioner was directly appointed, his initial
pay would have been fixed at Rs.29,920/-. But his pay has
been fixed, for being promoted to the post, at Rs.28,030/-
with effect from on 01.07.2014. Hence the petitioner by
means of the writ petition has urged before this court to direct
the respondents to set aside the said initial fixation of pay in
the post of Chief Librarian and fix his pay what would have
been in the case of the direct recruit. Consequently, the
challenge has been made against the order dated 16.07.2014
by which the initial pay of the petitioner has been fixed in the
post of Chief Librarian.
