JUDGEMENT

Arindam Lodh,J. - (1.)Heard Mr. D. J. Saha, learned counsel appearing for the accused-petitioners as well as Mr. S. Debnath, learned Addl. P.P., appearing for the State-respondent.
(2.)This is an application filed under Section 438 of Cr.P.C. for granting pre-arrest bail to the accused-petitioners, who have been evading arrest in connection with P.R. Bari Case No.100 of 2019 under Section 148, 149, 325, 353, 384 and 307 of IPC.
(3.)The matter involves land dispute. The accused petitioners along with others entered into altercation with the bailiff who went for execution of the judgment and decree passed by the Court of law. There was serious resistance on the part of the accused-petitioners and others to such execution of decree. From the materials on record produced before me, I find no incriminating materials attracting the provisions of Section 353, 384 and 307 of IPC. This Court vide order dated 05.12.2019 had granted bail to some of the accused persons. Accordingly, I am inclined to grant pre-arrest bail to the present accused-petitioners.
