(1.) Heard learned counsel, Mr. Somik Deb for the petitioner; learned Addl. G.A., Mr. S. Chakraroborty for the respondent Nos. 1, 2 and 3; learned counsel, Mr. T. Debbarma who appeared on behalf of learned counsel, Mr. P. Dutta for the respondent No.4 and learned counsel, Mr. S. Roy for the respondent No.13.
No representation on behalf of other respondents.
(2.) The petitioner was appointed as a member of Tripura Civil Service Grade-II (for short, TCS Grade-II) by notification dated 17.07.1990 (Annexure-P/1 to the writ petition). Respondent No.5 was shown in Sl. No.3 in the said notification dated 17.7.1990. It is the case of the petitioner that respondent No.6 to 15 were also selected and appointed in Grade-II of TCS after the petitioner. That contention of the petitioner has not been disputed by the respondents.
(3.) By notification dated 07.08.2009 (Annexure-P/3 to the writ petition) the petitioner was promoted to the post of TCS Grade-I (Selection Grade) and his name appeared in Sl.No.4. It is also admitted position that the name of respondent Nos. 5 to 15 appeared in the said notification below the name of the petitioner.
It is, therefore, admitted position that the petitioner was senior to the private respon-dents when they were promoted to TCS Grade-I (Selection Grade). ;
