(1.) This petition is filed by an association of Anganwadi workers. The petitioner has challenged a portion of the Recruitment Rules for the post of Early Childhood Coordinator promulgated by the State Government under a notification dated 08.05.2017. Essentially the petitioner objects to the requirement of teaching experience of minimum of 3 years from Government or Government recognized school for a candidate to be eligible for appointment on the said post.
(2.) Brief facts are as under :
In the State of Tripura there are 9911 Anganwadi centres, each looked after by one Anganwadi worker and one helper. These Anganwadi workers have limited promotional avenues. They are not considered regular Government servants and do not draw pay in the regular pay scales, instead they receive fixed honorarium every month.
(3.) The State Government created a new cadre of Early Childhood Coordinator with sanctioned posts and prescribed pay scales. The recruitment, pay scale and such other service conditions of Early Childhood Coordinators would be governed by the Early Childhood Coordinator Recruitment Rules (hereinafter to be referred to as the said Rules) framed by the Government in exercise of powers under Article 309 of the Constitution of India and promulgated under the above noted notification dated 08.05.2017. Under these rules the Government created 1000 posts of Early Childhood Coordinator in Group C Non-Gazetted posts in the pay scale of Rs.5700-24000 in PB-2 with Grade Pay of Rs.2200/-. The posts will be filled up 100% by direct recruitment. The educational and other qualifications required for recruitment reads as under :
'Madhyamik or its equivalent examination passed from recognized Board/Institution with 3(three) years teaching experience in any Govt./Govt. recognized school.' ;
