LAWS(TRIP)-2021-5-4
HIGH COURT TRIPURA
Decided on May 06,2021

Mousumi Bhattacharjee Appellant
VERSUS
STATE OF TRIPURA Respondents

JUDGEMENT

AKIL KURESHI, C.J. - (1.) Heard learned counsel Mr. C.S. Sinha for the petitioner and Mr. P.K. Dhar, learned Sr. Government Advocate for the respondents on advance copy.
(2.) Petitioner is a lady teacher in a Government school. Earlier, by an order dated 20.09.2020, she was transferred from Agartala to Khowai. Her case is that she has a 14 year old child, who is mentally retarded and the Government policy therefore would protect her from routine transfers. She had therefore approached the Government by filing a representation.
(3.) Looking to her special condition, the Government also passed an order on 25.01.2021 keeping her transfer order in abeyance. However, by further order dated 13.04.2021, she is transferred from Agartala to Baxanagar under Sepahijala District. Counsel for the petitioner drew my attention to an order dated 25.11.2020 passed by this Court in W.P. (C) No.769 of 2020 in case of Smt. Purnima Debbarma v. The State of Tripura and another and connected petitions in which the High Court had allowed the petitioners to make representations to the Government and requested the administration to consider such representations looking to the special family circumstances of such petitioners.;
