(1.) Heard Mr. A. Acharjee, learned counsel appearing for the appellant. Also heard Mr. K. De, learned counsel appearing for the respondent-insurance company.
(2.) With the consent of the parties, this appeal has been taken up for hearing and final disposal at the admission stage. Out of a road traffic accident, the claimant, the appellant herein, had filed an application under Section-166 of the Motor Vehicles Act for compensation. The claim application was contested by the respondents by filing their respective written statements. The accident was not disputed at the time of trial. The Disability Board had issued certificate in favour of the appellant showing his disability to the extent of 40% and the said certificate was valid for 5 years.
(3.) Mr. Acharjee, learned counsel appearing for the appellant has submitted that the said certificate was further extended up to another 5 years. The learned tribunal after considering the evidence on record, had awarded Rs.2,86,500/- in favour of the claimant-appellant and the liability was fastened upon the insurance company i.e. Iffco-Tokio General Insurance Company Limited.;
