ARINDAM LODH, J. -
(1.) Heard Mr. K. Nath, learned counsel appearing for the petitioners as well as Ms. N. Chakma Saha, learned counsel appearing for the State-respondents.
(2.) By means of filing this writ petition, the petitioners have prayed for the following reliefs:
i. Issue Rule upon the Respondents to show cause as to why a writ in the nature of Mandamus and/or order/orders and/or direction/directions of like nature shall not be issued whereby directing the Respondents to consider the petitioners for appointment in the vacant posts of Graduate Teachers (Class IX-X) in view of the fact, that, all the petitioners have scored above the cut off marks and the selection process was not only for 308 vacant posts under UR category but for remaining vacant posts under UR category;
ii. Make the rules absolute;
iii. Call for records;
iv. Pass any further order/orders as this hon'ble High Court consider fit and proper;
(3.) In a short compass, the grievance of the petitioners is that they underwent a proper selection process for appointment to the post of STGT (graduate teacher for class IX and X). It is the case of the petitioners that the vacant posts of graduate teachers (class IX and X) exists under the respondents. Out of the selection process, a merit list was prepared. The petitioners' names also appeared in the said select list. Out of that merit list, some of the candidates were appointed, but, the petitioners were not recommended for appointment. The grievance of the petitioners is that if the left out vacancies are filled up by the State-respondents then their names would definitely be considered.;
