(1.) Shri Ankur Shrivastava, learned counsel for the objector. The applicant has filed this first application u/S.439 Cr.P.C for grant of bail. Applicant has been arrested on 28/01/2021 by Police Station Obedullaganj, Distt. Raisen (M.P.) in connection with Crime No.306/2019 registered for offence under Sections 363, 376(2)(n) of IPC and Sections 5L, 5j(ii), 6 of POCSO Act.
(2.) It is submitted by learned counsel for the applicant- Ahsan Shah that the applicant has not committed any offence. He has falsely been implicated in this case. Applicant is in custody since 28/01/2021, i.e. for more than three months. Only omnibus allegations are made against the present applicant. It is further submitted that the investigation is complete and charge-sheet has been filed. It is also submitted that trial will take its own time as due to present situation of COVID-19 pandemic, there is no possibility of commencement of trial in near future. Hence, learned counsel prays for grant of bail to the present applicant. He further undertakes to abide by all the terms and conditions of guidance, circulars and directions issued by Central Government, State Government as well as Local Administration regarding measures in respect of COVID-19 Pandemic and maintain hygiene in the vicinity while keeping physical distancing.
(3.) Learned counsel for the objector has submitted that he has no objection in case of grant of bail to the applicant.;
