JUDGEMENT

- (1.)The applicant has filed this first bail application u/S.439 Cr.P.C for grant of bail. Applicant has been arrested on 30.12.2019 by Police Station Sehrai, District Ashoknagar, in connection with Crime No.130/2019, registered for offence under Sections 302 , 201 , 120-B , 34 of IPC and Sections 25 / 27 of the Arms Act.
(2.)It is the submission of learned counsel for the applicant that main allegations are against her husband namely Kanchhedilal and not against the present applicant. Only allegation against the present applicant is that she accompanied main accused to the place of deceased who happens to be mother of main accused Kanchhedilal. Applicant being a lady aged about 45 years, is suffering confinement since 30.12.2019 whereas charge-sheet has already been filed. She does not bear any criminal record. Chance of tampering with the evidence / witnesses is remote. Confinement amounts to pretrial detention. She undertakes to cooperate in trial and would not be a source of embarrassment or harassment to the complainant. Looking to the peculiar situation of COVID-19, sympathetic consideration be made. She further undertakes to serve the national cause by making contribution in Army Central Welfare Fund and to install Arogya Setu App. On these grounds, prayer for bail has been made. 1 Learned PL for the State opposed the prayer and prayed for dismissal of this application. 2 Heard learned counsel for the parties at length through VC and considered the arguments advanced by them.
(3.)Considering the facts of the case in detail, however, considering the fact that in view of COVID-19 pandemic, without commenting on the merits of the case, it is hereby directed that the applicant shall be released on bail on her furnishing personal bond of Rs.50,000/- (Rupees Fifty Thousand Only) with one solvent surety of the like amount to the satisfaction of trial Court. She further undertakes to install Arogya Setu App., if not already installed.
