ANKLESH Vs. STATE OF MADHYA PRADESH

JUDGEMENT

(1.) This is third repeat bail application under Section 439 of the Criminal Procedure Code, 1973. The applicant is in jail since 09.12.2019 in connection with Crime No.495/2019 registered at P.S., Annapurna, District Indore, for offence punishable under Section 454 , 380 , 109 , 411 of IPC.

(2.) The first bail application vide M.Cr.C.No.1652/2020 was dismissed as withdrawn on 31.01.2020. The second bail application vide M.Cr.C.No.10983/2020 was also dismissed as withdrawn on 22.06.2020.

(3.) As per prosecution story, one- Dilip Gupta lodged a complaint against unknown persons with allegation of house trespass and commission of theft of bullion and jewellery at Police Station Annapurna, District Indore. Co- accused Kailash More was arrested in Crime Case No.346/2016 registered under Section 307 / 34 of IPC and Sections 25 and 37 of Arms Act. During the investigation, it was revealed that he has committed theft in the house of the complainant -Dilip Gupta alongwith co-accused persons namely; Virdendra, Lalan, Kailash, Jaiprakash and Ajay.
