(1.)This writ petition is filed by the 1st petitioner, which is a society running the 2nd petitioner-school. They have sought permission from the respondents to establish a new private Un-aided school namely Aakruti UP School (EM), Kovvuru, in East Godavari District. The permission was negatived. Questioning the same, the present writ petition has been filed.
(2.)This Court has heard Sri K.Gani Reddy, learned counsel for the petitioners and Government Pleader for School Education, for respondents.
(3.)The case of the petitioners is that they are aggrieved by the proceedings dated 05.12.2018 by which the proposals sent by the petitioner to establish a new school were rejected. The petitioners applied to respondent No.3 to open a new school from 1st class to 7th class, as the permission is necessary. Respondent No.6-Grampanchayat rejected the application made. The case of the petitioners is that they have constructed the building as per the prevalent norms and that they have done all that is necessary to secure the permission from the respondents to establish the school. They contend that all the necessary approvals for construction of the building etc., have been obtained and that the action of the respondents in rejecting their request is absolutely un-called for. It is his contention that the request was rejected on extraneous grounds and that therefore, the petitioners are entitled to a writ of Mandamus as prayed for.
