JUDGEMENT

U.Durgaprasad Rao, J. - (1.)The complainant Pallem Padmaja identified by her counsel Sri Ch.N. Mehar Baba. The accused is in jail and his son U. Sai Durga Prasad is present and identified by his counsel Sri T.D. Phani Kumar.
(2.)The complainant filed C.C.No.421 of 2014 on the file of learned V Additional Judicial Magistrate of First Class, Kakinada, East Godavari District, under Section 138 r/w.Sec.142 of Negotiable Instruments Act (for short, "N.I. Act") on the allegation that cheque for Rs.1,60,000/- dated 08.02.2014 issued by the accused towards part payment of the pronote debt bounced back. The accused contested the matter. The trial Court convicted the accused and sentenced him to undergo Simple Imprisonment for six months and also sentenced to pay fine of Rs.5000/- , in default to suffer S.I for one month.
(3.)Aggrieved, the accused preferred Criminal Appeal No.355 of 2015 before the learned III Additional Sessions Judge, East Godavari at Kakinada and the same was dismissed by confirming the judgment dated 03.07.2015 passed by the trial Court.
Aggrieved, the accused preferred the instant Crl.R.C.No.953 of 2019.
